1.1. In addition to the Terms and conditions that govern the use of the www.ithq.qc.ca Website (“Website”), the sale of products and services by the Hôtel de l’ITHQ is subject to these Terms of Sale.
1.2. The Institut de tourisme et d’hôtellerie du Québec (3535 Saint-Denis Street, Montréal, Québec H2X 3P1, hereinafter “ITHQ,” “Hôtel de l’ITHQ” or “we”) operates the Website and is the supplier of the products and services found therein. By making a reservation at the Hôtel de l’ITHQ, which requires acceptance of these Terms of Sale, you agree to be bound by them whether or not you have read them. If you do not accept these Terms of Sale, please do not make a reservation.
1.3. Please print and keep a copy of these Terms of Sale for your records.
Purpose of agreement
1.4. The ITHQ agrees to rent you hotel rooms for your accommodation and deliver any other service that the ITHQ provides in accordance with the Terms of Sale below.
Group Reservations
1.5. A group reservation at the Hôtel de l’ITHQ means a reservation made by a single customer for two (2) rooms or more for the same period for a total of five (5) nights or more. To calculate the total stays, the number of reserved rooms is multiplied by the number of reserved nights. For example, a reservation for five (5) rooms for two (2) nights is equivalent to ten (10) nights.
1.6. A Group Accommodation Agreement must be signed with the Hôtel de l’ITHQ for any group booking. For more information or to obtain this agreement, please contact the hotel reception at 514-282-5120 or [email protected].
1.7. These Terms of Sale are complementary to the terms and conditions set out in the Group Accommodation Agreement of the Hôtel de l’ITHQ. In the case of any inconsistency between a provision of the Group Accommodation Agreement and a provision of these Terms of Sale, the provision of the Group Accommodation Agreement shall prevail while in no way affecting the validity or enforceability of the remaining provisions of either of these documents.
Check-in procedures
1.8. Identification. You must identify yourself when you arrive at the Hôtel de l’ITHQ. When you check in at the front desk, you must present a valid government-issued photo identification and a valid physical credit card (i.e. virtual cards on a cell phone are not accepted) in a name that matches the one used for the reservation. If you are unable to present one or both of these items, your reservation will be cancelled. The Hôtel de l’ITHQ may then charge you an amount equal to what you would have paid for the first night of your reservation if the room(s) you reserved are not reserved by another guest.
1.9. Additional guests. You must inform the Hôtel de l’ITHQ of all guests staying in the reserved room and provide their names and ages. No room may be reserved for a capacity that exceeds the number indicated. Access to the room will be limited to these individuals and your temporary visitors only, as per the conditions and limitations of these Terms of Sale.
1.10. Pets. If you wish to bring your pet, you must inform the Hôtel de l’ITHQ and agree to adhere to the related conditions by signing the Terms and Conditions for Bringing Pets to the Hôtel de l’ITHQ.
1.11. Parking. An indoor parking lot operated by the Société Parc Auto du Québec (SPAQ) is available at the Hôtel de l’ITHQ. Any guest of the Hôtel de l’ITHQ who wishes to park there must pay the rate set by the SPAQ. Parking is also subject to availability during your stay.
1.12. If you need a parking space, you must provide the Hôtel de l’ITHQ reception staff with the details of your vehicle, i.e. licence plate number, make and colour. You will receive a parking pass once you have paid the applicable rate.
1.13. The Hôtel de l’ITHQ does not offer valet parking and assumes no responsibility whatsoever for any theft or damage that may occur in the parking lot.
1.14. Bicycle rack. A bicycle rack is available in the indoor parking lot operated by SPAQ.
1.15. Luggage storage service. On the last day of your stay at the hotel, you may use the Hôtel de l’ITHQ’s luggage storage service.
Cancellation policy and fees
1.16. The Hôtel de l’ITHQ may cancel any reservation due to force majeure. In this case and if possible, you will be offered another hotel room at no extra charge.
1.17. Reservations made directly with the Hôtel de l’ITHQ may be cancelled at no charge if the cancellation is requested no later than twenty-four (24) hours prior to your scheduled check-in date.
1.18. Any reservations made with a third-party online travel agency (e.g. Booking.com, Expedia) may be cancelled without fees if you submit the request directly to the agency in question no later than seventy-two (72) hours before your scheduled check-in date.
1.19. The Hôtel de l’ITHQ will charge your credit card an amount equal to the price you would have paid for the first night of your reservation if you do not cancel your reservation before the required deadline and if the room(s) you reserved are not reserved by another guest.
1.20. Note that the cancellation terms set out in the Hôtel de l’ITHQ’s Group Accommodation Agreement, which must be signed to make a group reservation as per sections 1.5 to 1.7 of these Terms of Sale, differ from and take precedence over the cancellation terms described above. If you want to cancel a group booking, refer to the terms in the Group Accommodation Agreement that you signed.
Check-in time and no-show
1.21. Check-in starts at 4:00 p.m. on the first day of your reservation. Early check-in is only possible depending on the room’s availability. In this case, you will be charged an additional fee of $50 if you arrive before 10:00 a.m. or $30 if you arrive between 10:00 a.m. and 2:00 p.m.
1.22. Unless it has been expressly agreed that you may arrive after midnight on the first day of your reservation or the room(s) in question have been paid for in advance, the Hôtel de l’ITHQ has the right to rent the reserved room(s) to any other guest as of midnight on the first day of your reservation if you fail to show at the hotel reception desk before that time, and you will not be able to make any claims against the Hôtel de l’ITHQ as a result.
1.23. The Hôtel de l’ITHQ will charge your credit card an amount equal to the price you would have paid for the first night of your reservation if you do not show and if the room(s) you reserved are not reserved by another guest.
1.24. A late arrival will not entitle you to a refund or a reduction in the total amount invoiced for your reservation at the Hôtel de l’ITHQ.
Check-out
1.25. You must leave the hotel room before 12:00 p.m. (noon). Late departures are subject to an additional fixed fee of:
- $50 after 1:00 p.m.
- $100 after 2:00 p.m.
- Half the total price of an additional night (at the prevailing rate) after 3:00 p.m.
- The full price of an additional night (at the prevailing rate) after 4:00 p.m.
1.26. An early check-out does not entitle you to a refund or reduction in the total amount charged for your reservation at the Hôtel de l’ITHQ.
Room access and key management
1.27. When you arrive, the Hôtel de l’ITHQ will provide you with electronic keys to your room for the duration of your stay. You may not give these keys to a third party. If you wish to extend your stay, you must go to the reception desk to get new keys. If you would like an additional key, you must make a request at the reception and, if applicable, provide the name of the person using the key. All keys must be returned on the day of check-out.
1.28. For security reasons, the Hôtel de l’ITHQ will retain access to your room during your stay. The Hôtel de l’ITHQ staff may access your room during your stay in the event of an emergency or if a major problem is suspected.
Pre-authorized credit card amount
1.29. When you check-in, a pre-authorization of an amount corresponding to the total value of the nights of your stay plus an amount of $150.00—for any additional fees that may be charged to your account during your stay—must be made by a Visa, Mastercard or American Express credit card. No other payment method will be accepted for this mandatory pre-authorization.
1.30. The additional pre-authorized amount of $150.00 will be constantly re-applied during your stay. For example, if you charge $60 to your account for a meal at the Restaurant de l’ITHQ, the total pre-authorization amount will then correspond to the total value of the nights of your stay, plus an amount of $60 for your meal at the Restaurant de l’ITHQ, plus an amount of $150.00 for any other additional charges.
1.31. The pre-authorized amount will create a temporary hold on the credit card that you used. Pre-authorization lets the ITHQ establish your ability to pay the final amount for your stay at the Hôtel de l’ITHQ.
1.32. Any pre-authorized amount exceeding the total actual cost of your stay at the Hôtel de l’ITHQ will become available again on your credit card within ten (10) business days of the end of your stay. The exact time the hold is removed will vary depending on your financial institution’s processing times.
1.33. Note that if your reservation at the Hôtel de l’ITHQ requires you to sign a Group Accommodation Agreement, the pre-authorization amount may be applied prior to your check-in. One or more deposits may also be required as per the terms and conditions set out in the agreement.
Payment, pricing and billing
1.34. At the end of your stay at the Hôtel de l’ITHQ, you must pay an amount corresponding to the actual total value of your stay. This final payment can only be made by the following methods: debit card; Visa, Mastercard or American Express credit card; cash.
1.35. You must pay for the hotel rooms and any other services that you used as per the rates in effect at the time of your purchase. This also applies to services that the ITHQ provides for the benefit of third parties at your request or at the request of a person under your responsibility.
1.36. The rates are calculated based on room type, number of rooms, number of nights and availability at the time of the reservation. If you ask the Hôtel de l’ITHQ to change your reservation and this change is accepted, the cost of your reservation may also change as per the above-mentioned attributes, i.e. room type, number of rooms and nights, and the availability at the time the change is requested. The additional fees that you agree to pay once your reservation has been changed are non-negotiable and non-refundable.
1.37. The Hôtel de l’ITHQ may accept or refuse any request to change your reservation at its discretion.
1.38. The price indicated at the time of the reservation covers the room rental fees at the Hôtel de l’ITHQ as well as breakfast for the number of people indicated in your reservation. When you check in, additional fees will be charged if it is found that more people are staying in the reserved room than the number you indicated in your reservation.
1.39. Children under 12 can stay and eat breakfast for free when they share a room with their parents.
1.40. If you have a promotional code allowing you to benefit from a preferential rate as a friend or family member of an ITHQ staff member, this promotional code will be valid and applicable only provided that the said ITHQ staff member has adequately designated you as a friend or family member entitled to this preferential rate with the Hôtel de l’ITHQ at least 48 hours before your scheduled arrival date. If no ITHQ staff member has designated you in accordance with the internal procedure established by the Hôtel de l’ITHQ, you will not be able to benefit from the promotional code and, as a result, the cost of your reservation will be adjusted to the regular rate applicable to the room you have booked on the day of your check-in.
Currency and taxes
1.41. The rates for rooms and other services at the Hôtel de l’ITHQ are listed exclusively in Canadian dollars (Can$).
1.42. Federal tax (GST) of 5% and provincial tax (QST) of 9.75% apply to all products and services sold by the Hôtel de l’ITHQ.
1.43. The 3.5% tax on lodging also applies to the price for all nights reserved at the Hôtel de l’ITHQ.
Repairs for dammage to the Hôtel de l’ITHQ
1.44. The ITHQ reserves the right to invoice you for any and all expenses incurred to repair any damage of any nature whatsoever caused by you, by the individuals accompanying you, by your children, or by your temporary visitors. For example, if any harm or damage is caused to the premises or equipment of the Hôtel de l’ITHQ, whether the damage was intentional or unintentional, the Hôtel de l’ITHQ may invoice you for additional costs for cleaning and replacement as well as related costs, such as for maintenance services, management services, repairs, deliveries, loss of profits due to the duration of the work, etc.
Good and appropriate conduct
1.45. The Hôtel de l’ITHQ is a place of education where ITHQ students learn and develop. We expect all guests and visitors at the ITHQ to show a particularly respectful attitude toward its people and premises. The following individuals will therefore not be allowed to stay on the ITHQ’s premises:
- Anyone deemed to be dressed indecently.
- Anyone exhibiting aggressive or noisy behaviour.
- Anyone appearing to be intoxicated by alcohol or drugs.
- Anyone whose behaviour is contrary to good conduct or public order.
1.46. Any noise that may disturb other guests at the Hôtel de l’ITHQ will not be tolerated under any circumstances. Furthermore, guests, anyone accompanying guests, and temporary visitors must take special care not to disturb the peace and quiet of other guests at the Hôtel de l’ITHQ between 9:00 p.m. and 7:00 a.m.
1.47. Any guest who contravenes the sections pertaining to good and appropriate conduct will be removed from the Hôtel de l’ITHQ and will not be entitled to a refund for their stay. The Hôtel de l’ITHQ also reserves the right to charge the credit card of any removed guest for an amount corresponding to the ITHQ’s reimbursement to guests who left the hotel due to the nuisance caused by the removed guest.
Conduct inside the premises
1.48. All people accompanying you, including children and temporary visitors, are your responsibility. You are not allowed to leave children unattended in a room or in any other area of the Hôtel de l’ITHQ.
1.49. All items, accessories, equipment, materials and amenities provided to you during your stay must remain in good condition.
1.50. The use of cooking or heating appliances such as barbecues, ovens, hotplates, candles or any other open flame of any kind is strictly prohibited.
1.51. You are authorized to receive temporary visitors in your room. The maximum number of temporary visitors depends on the type of room reserved:
- Classic room: 4 temporary visitors
- Universelle room: 4 temporary visitors
- Prestige room: 4 temporary visitors
- Junior suite: 6 temporary visitors
- Executive suite: 12 temporary visitors
1.52. After 11:00 p.m., all temporary visitors must register at the reception desk before being allowed access to a room. The Hôtel de l’ITHQ reserves the right to ask you to escort your temporary visitors from the reception desk to your room.
1.53. Under no circumstances may rooms be used for parties, celebrations, points of sale or business meetings without the prior written consent of the hotel’s management.
1.54. For legal and safety reasons and to respect others, smoking and vaping are strictly forbidden in all private and common spaces and on all balconies at the Hôtel de l’ITHQ. If this policy is violated, you will incur a $500 penalty, paid as additional fees, as set forth in the article entitled ‘Repair of damages caused to the Hôtel de l’ITHQ’ herein, and incur charges for restarting the fire detection system if the fire alarm is unintentionally triggered or for repairs to property if the water sprinklers are triggered.
Use for purposes other than accommodation
1.55. Using the reserved hotel room(s) for a purpose other than accommodation for yourself or anyone accompanying you during your stay requires the prior written consent of the Hôtel de l’ITHQ and may be subject to an additional fee.
1.56. Using the hotel rooms to carry out any form of commercial activity is strictly prohibited. Any guest who violates this policy must pay all fees for the reservation and services rendered and must immediately leave the premises.
Advertising
1.57. Any form of newspaper, TV or brochure advertising distributed to the public for events held at the Hôtel de l’ITHQ must be approved by the ITHQ Director of Communications before being broadcast or circulated on its premises.
Interpretation
1.58. Whenever a time is indicated in these Terms of Sale, this refers to local time in Montréal (the city where the Hôtel de l’ITHQ is located).
1.59. All cut-off times or deadlines mentioned in these Terms of Sale are given or calculated based on local time in Montréal (the city where the Hôtel de l’ITHQ is located).
